Terms of Service

Last updated: October 24, 2026

These Terms of Service ("Terms") govern your use of themiraclemarketing.com (the "Site") and the services provided by Miracle Growth Marketing, LLC, a Virginia limited liability company doing business as Miracle Marketing ("Miracle Marketing," "we," "us" or "our"). By using the Site or signing an order form, proposal or invoice for our services (an "Order"), you ("Client") agree to these Terms. If an Order conflicts with these Terms, the Order controls for that service. Our Services are for businesses and organizations, not for personal or household use.

1. Services

We provide marketing and lead-follow-up systems, AI employees (voice and chat assistants), managed websites, and paid advertising management, as described in your Order. Services start when the Order is accepted and any setup fee is paid.

2. Fees and Billing

  • Setup fees are due before work begins. Recurring fees are billed monthly in advance, unless your Order says otherwise.
  • Fees exclude taxes. You are responsible for applicable sales, use and value-added taxes.
  • If a payment fails or is more than seven (7) calendar days overdue, we may pause the Services until the account is current. We may charge interest or costs of collection where the law allows.
  • Prices, packages and features may change for new Orders. We will give you at least 30 days' notice before changing the recurring fee on an existing Order.

3. Minimum Terms and Cancellation

Where the Site or your Order states a minimum commitment (for example, a 12-month minimum for a managed website plan), that minimum applies. After any minimum term ends, recurring services continue month to month and you may cancel at any time by giving 30 days' written notice to info@themiraclemarketing.com. You remain responsible for fees through the end of the notice period. If you cancel during a minimum term, the remaining fees for that term stay payable unless your Order says otherwise. Setup fees are non-refundable once we have started work. If we have not started any work, you may ask for a refund of the setup fee within 24 hours of payment. After that, development and deployment begin and the setup fee is considered earned. If we fail to deliver the Services on time as stated in your Order, you may cancel early and will not owe the remaining fees for the minimum term.

4. Paid Advertising

  • Ad spend is separate. Money paid to advertising platforms such as Google, Meta, TikTok or YouTube is paid by you directly to the platform, or reimbursed to us at cost if we agree to advance it, and is not part of our management fee.
  • You own your ad accounts. We act as your authorized manager, and you remain responsible for platform fees, account standing and the accuracy of your offers and claims.
  • Platform rules. Platforms may reject ads, change prices or suspend accounts at any time. We are not liable for those decisions.
  • No guaranteed results. Advertising results depend on budget, market, offer and platform behavior, and we do not promise a specific number of leads, sales, rankings or return on ad spend.

5. AI Employees, Automation and Messaging

  • AI can make mistakes. AI assistants may give incomplete or incorrect answers. You are responsible for reviewing the information, scripts and answers you give the assistant, and for choosing which tasks it handles. AI assistants are not for emergencies or for legal, medical or financial advice.
  • Consent and lawful messaging. You are solely responsible for having valid consent, and for any required disclosures, before we send texts, emails or calls to your contacts or record calls. This includes compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, Canada's Anti-Spam Legislation (CASL), and call-recording and AI-disclosure laws in the places you operate. Do not upload purchased or scraped lists.
  • Opt-outs. We will honor STOP and unsubscribe requests, and you must not ask us to message anyone who has opted out.
  • Carrier registration. US mobile carriers require business registration for text messaging (A2P 10DLC). You agree to give accurate registration information. Carriers decide approval, and we may suspend messaging that violates carrier rules.
  • Text messages from us. If you ask us to contact you and agree to receive texts, we may text you about your request, appointments, follow-ups and our services. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, or HELP for help, or email info@themiraclemarketing.com. Consent to receive texts is not a condition of buying anything from us. Wireless carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle mobile numbers and text-message consent.

6. Websites and Hosting

Managed websites are provided as a subscription service on platforms we choose and maintain. While the subscription is active, we host, secure and maintain the website. You keep ownership of your domain name, your content, logos and photos. We keep ownership of the design framework, templates, code and tools we create, which you may use during the subscription. Our websites and related services are provided as a subscription. When the subscription ends, access ends, and we do not provide a copy or export of the website, templates, code, automations or tools. Your domain name, content, logos and photos remain yours, and on request we will return the original files you gave us.

7. Client Responsibilities and Acceptable Use

  • Give us accurate information, content, access and timely approvals. Delays on your side can delay results.
  • Make sure everything you ask us to publish or send is true, lawful and does not infringe anyone's rights.
  • Do not use the Services for unlawful, deceptive, harassing or abusive purposes, or in a way that breaks platform or carrier rules.

8. Intellectual Property

You own the content you provide and grant us a license to use it to deliver the Services. We own our methods, templates, software, systems and pre-existing materials. Unless you tell us in writing not to, we may name you as a client and describe the work in general terms. Our website, its content, designs, materials and methods are protected by copyright and other laws. You may not copy, scrape, reproduce or adapt them, or use them to build a competing service, without our written permission.

9. Third-Party Platforms and Services

The Services depend on third parties such as advertising platforms, search engines, phone and text carriers, hosting and software providers. We are not responsible for their outages, policy changes, pricing or decisions.

10. No Guarantee of Results

We work to improve your marketing and response times, but we do not guarantee any particular business outcome, search ranking, lead volume or revenue. Examples and figures on the Site are illustrations, not promises.

11. Limitation of Liability

To the fullest extent the law allows, Miracle Marketing is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the Services is limited to the fees you paid us for the affected Service in the three (3) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to defend and indemnify Miracle Marketing against third-party claims, fines and costs arising from the content, lists, offers and instructions you provide, your breach of these Terms, or your violation of law.

13. Suspension and Termination

We may suspend or end Services immediately if you breach these Terms, fail to pay, or use the Services unlawfully. Sections that by their nature should survive termination, including payment, intellectual property, liability and governing law, will survive.

14. Privacy

Our Privacy Policy explains how we handle personal information, and forms part of these Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. The state and federal courts located in Virginia have exclusive jurisdiction over disputes, and each party consents to that jurisdiction. Before filing a claim, each party will first try in good faith to resolve the dispute by written notice and discussion for 30 days.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date shows the current version, and changes apply to new Orders and renewals after they are posted. Continued use of the Services after a change means you accept it.
